For Wrensilva® Products Purchased From Authorized Wrensilva Retailers
1. What is the warranty period?
This warranty protects you for a period of one (1) year (“Warranty Period”) from your date of delivery as stated in your bill of sale or as otherwise established by Wrensilva LLC
(“Wrensilva” or “we” or “us”). The Warranty Period is applicable to all Wrensilva products, regardless of each product type or model. Any warranty service or parts replacement will not extend the Warranty Period. Any warranty replacement parts or product will assume only the remainder of Warranty Period of the original product.
2. What does this warranty cover, and what does it not cover?
Except as otherwise stated in this policy, this warranty covers defects in materials and workmanship if: (1) you purchased this product from a dealer that is a Wrensilva authorized dealer with respect to this product at the time of your purchase; (2) your original, dated bill of sale is presented whenever warranty service is required during the warranty period; and (3) unless Wrensilva states otherwise, you purchased this product in brand new condition.
This policy does not cover damage or loss: caused by accident (including force majeure or natural forces), misuse, abuse, neglect, product modification; occurring during shipment (even when Wrensilva has arranged or paid for shipping); caused by failure to follow instructions in the owner’s guide, including failure to perform recommended periodic or routine maintenance, if applicable; resulting from repairs by someone Wrensilva did not authorize; (for products not specified by Wrensilva for commercial or industrial use) caused by any commercial or industrial use; to the decorative surface of this product; to any data, software or information; caused by using this product for other than its intended purpose; or covered under any of your (or your installer’s) insurance policy or coverage. The following are also excluded from this warranty: claims based upon any misrepresentations by any reseller or agent; if this product’s serial number has been altered, defaced or removed; deterioration of component parts, the nature of which is to become worn or depleted with use; any accessory to this product, even if supplied by Wrensilva; any installation, removal or reinstallation; any set-up calibration or adjustment; any performance variations due to installation related circumstances, such as program source quality or AC power fluctuations.
Wrensilva reserves the right to change the design of, or upgrade, any product from time to time without notice and with no obligation to make any changes or upgrades to any products previously sold or manufactured.
3. What will Wrensilva do to correct problems under warranty?
If this product has a defect covered by this warranty, Wrensilva will, at its option, either: (1) repair this product at no charge to you, using new or refurbished replacement parts, (2) exchange this product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to this product, or (3) refund the purchase price of the product. Any replaced or refunded parts or products shall become Wrensilva property, and, by submitting any product for warranty service, you represent and warrant to Wrensilva that you are the sole owner of such product, and that it is not subject to any liens or encumbrances.
4. Who is protected by the warranty?
This warranty protects only the original end-user (“you” or “your” or “Buyer”), and is not transferrable. Any attempt to transfer this warranty shall immediately make this warranty void. This warranty is valid only for Wrensilva products purchased from authorized Wrensilva dealers within the fifty United States, and it does not apply to products purchased or transferred elsewhere. If you purchased this product (or have subsequently transferred it) outside the fifty United States, you should contact your local Wrensilva distributor for warranty information.
5. How can warranty service be obtained?
In the event that you require warranty service on this product, you should first contact us directly at email@example.com or 1-800-292-6353.
Please be prepared to provide detailed information on the symptoms or difficulties you have observed with the product’s performance. We may direct you to an authorized service center or ask you to send the product to us for repair. In either case, you will have to present your original bill of sale to establish warranty coverage. Do not send a product to us without prior authorization. Warranty repair of this product must be done by an authorized dealer or service center. To the fullest extent allowed by law, unauthorized warranty repair will void the warranty and is done at your risk.
6. How do I return a product under warranty?
To return a product to Wrensilva, please follow the instructions set out below:
1. Contact Wrensilva. To return a Wrensilva product to Wrensilva, you must inform Wrensilva that your product is defective within one (1) year from the original shipment date. After providing Wrensilva with the details of your defective product, you will be provided with a Return Merchandise Authorization (RMA). Just call us at the free phone number or use any of the other contact methods listed.
2. Use the Wrensilva shipping label and save a copy. You will receive an email confirming the RMA number. This email will include a prepaid returns shipping label. Use the Wrensilva shipping label you have received and follow the shipping instructions set out on the label to send the products back to Wrensilva. Please ensure that all previous shipping labels or other markings have been removed or covered completely prior to applying the provided return shipping label. Retain a copy of the shipping label with the applicable tracking number signed by an agent of the carrier.
3. Return the product within 14 days of the RMA issue. Wrensilva must receive the returned item within 14 calendar days after an RMA number has been issued and the unit returned must match the serial number specified in the RMA. Make sure you pack the product in a safe packaging. All contents (brochures and wires) need to be included.
4. Receive your refund or a repaired or replacement product. If you have returned the product within the warranty period, provided your return meets the above conditions, you may expect to see a credit to your account within 10 –15 business days. Credit will be issued in the same manner as your original purchase payment.
If you are receiving a repaired or replacement product, your product will ship following receipt and inspection of your original product. Shipping times will depend on the extent of repairs required and/or time necessary to produce a replacement product. We may require a valid credit card number to ship a replacement product.
If we do not receive the original product(s) within 14 days, or if we determine that the problem with your product(s) is not covered by the Wrensilva Warranty, we reserve the right to charge the then-current standard price for the applicable product(s) to your credit card or the original form of payment used at the time you placed your original order.
WARRANTY & DISCLAIMER
Wrensilva warrants that the goods supplied will be free of defects in material and in workmanship for a period of 1 year. Normal wear and tear or damage from daily use is not warranted. Claims for defective goods shall be deemed waived and released by the Buyer unless made in writing within thirty (30) days after arrival of goods.
NOTWITHSTANDING THE FOREGOING, WRENSILVA SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, DIRECTLY OR INDIRECTLY, OR ARISING FROM THE USE OF SUCH GOODS OR FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
BY PURCHASING A WRENSILVA PRODUCT, YOU ARE (1) REPRESENTING THAT YOU ARE OVER THE AGE OF 18, (2) REPRESENTING THAT YOU HAVE THE RIGHT AND AUTHORITY TO LEGALLY BIND YOURSELF OR YOUR COMPANY, AS APPLICABLE, AND (3) CONSENTING TO BE LEGALLY BOUND BY ALL OF THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL THESE TERMS OR CANNOT MAKE SUCH REPRESENTATIONS, DO NOT PURCHASE A WRENSILVA PRODUCT.
THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. WRENSILVA SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF WRENSILVA CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY.
No Wrensilva reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.
In the event that there is a difference between this warranty and the provisions in any owner’s manuals, warranty leaflets, or packaging cartons, the terms of this warranty will prevail to the fullest extent allowed by law.
LIMITATION OF LIABILITY
WRENSILVA’S LIABILITY (WHETHER UNDER THE THEORIES OF BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE, OR STRICT LIABILITY) FOR ITS GOODS SHALL BE LIMITED TO REPAIRING OR REPLACING PARTS FOUND BY WRENSILVA TO BE DEFECTIVE OR, AT WRENSILVA’S OPTION, TO REFUNDING THE PURCHASE PRICE OF SUCH GOODS OR PARTS. AT WRENSILVA’S DIRECTION, THE BUYER WILL SEND, AT THE BUYER’S SOLE EXPENSE, ANY ALLEGEDLY DEFECTIVE GOODS TO THE PLANT OF WRENSILVA WHICH MANUFACTURED AND/OR ASSEMBLED AND/OR PROCESSED THEM. WRENSILVA WILL NOT DEFEND OR INDEMNIFY BUYER EXCEPT AS EXPRESSLY APPROVED OR AGREED TO IN WRITING BY WRENSILVA.
IN NO EVENT SHALL WRENSILVA BE LIABLE FOR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY TRANSACTION INVOLVING THE GOODS PROVIDED BY WRENSILVA, INCLUDING WITHOUT LIMITATION, BREACH OF ANY OBLIGATION IMPOSED ON WRENSILVA HEREUNDER OR IN CONNECTION HEREWITH. CONSEQUENTIAL DAMAGES FOR PURPOSES HEREOF SHALL INCLUDE, WITHOUT LIMITATION, LOSS OF USE, INCOME OR PROFIT, OR LOSSES SUSTAINED AS THE RESULT OF DELAY, INJURY, (INCLUDING DEATH TO ANY PERSON) OR LOSS OF OR DAMAGE TO PROPERTY (INCLUDING WITHOUT LIMITATION PROPERTY HANDLED OR PROCESSED BY THE USE OF THE GOODS). THE BUYER SHALL INDEMNIFY WRENSILVA AGAINST ALL LIABILITY, COST OR EXPENSE WHICH MAY BE SUSTAINED BY WRENSILVA ON ACCOUNT OF ANY SUCH LOSS, DAMAGE OR INJURY CAUSED BY OR RELATED TO THE ACTIONS OF BUYER.
All orders are accepted with the understanding that they are subject to Wrensilva’s current manufacturing schedules, and government regulations, orders, directives, and restrictions that may be in effect from time to time. Wrensilva shall not be liable for delays due to circumstances or acts beyond its control including, without limiting the generality of the foregoing, accident, strike or other labor troubles or disputes, flood, fire, war, or Act of God, civil commotion, lack of or inability to obtain labor or materials, embargo, delays in transportation, or because of compliance with any law or other governmental action, requirements, regulations or restrictions.
Buyer agrees to save and hold Wrensilva harmless from any claims, demands, liabilities, costs, expenses or judgments arising in whole or in part, directly or indirectly, out of the negligence or lack of care by Buyer or Buyer’s customers, agents, employees or invitees involving the use of the goods supplied by Wrensilva. This indemnification shall include all costs, attorney’s fees and other expenses paid or incurred by or imposed upon Wrensilva in connection with the defense of any such claim.
